Winter Storage Contract 2021 to 2022
1. Ownership: The person or persons designated as “Owners” as it appears on this contract, who have executed the Agreement, acknowledge that they are the legal owner or one or more of the co-owners of the boat with authority to act on behalf of all owners and are authorized to enter in this agreement.
2. Owner shall not be permitted to assign or transfer this Agreement. The owner shall immediately notify Bedford Sales & Outdoors in writing of any changes in ownership of the boat subject to this agreement. Notwithstanding any changes in ownership of the boat, owner shall remain responsible for any and all payments and obligations under this Agreement, unless the new owner enters into a new agreement with Bedford Sales & Outdoors for the storage of the boat and Bedford Sales & Outdoors accepts such agreement.
3. Should the owner require repairs and/or service work to their boat while the boat is being stored by Bedford Sales and Outdoors, owner agrees to have Bedford Sales & Outdoors and/or contractors approved by Bedford Sales & Outdoors perform any and all repair/service work. The owner agrees to accept full responsibility for the actions of such persons or organizations, and the owner agrees to indemnify and hold harmless forever Bedford Sales & Outdoors for any and all claims that may arise from work performed and/or the actions of those contractors. No unauthorized contractors will be allowed to perform work on boats in any Bedford Sales & Outdoors storage facility. Should the owner arrange for repair/service work from a company other than Bedford Sales & Outdoors and/or its authorized contractors a service fee of $75 will be charged to remove and return the boat to storage.
4. All boat owners MUST MAINTAIN THEIR OWN INSURANCE COVERAGE to protect against liability, theft, pilferage, vandalism, fire, windstorm, snowstorm, or other casualty or loss. This release, hold harmless and discharge of obligation shall cover without limitation any loss or damage resulting from Bedford Sales & Outdoors employees parking or hauling customer’s boat, collision, vandalism, theft, fire, hail, high/low water, wind, ice, rain and any acts of God. Customer waives any subrogation right against Bedford Sales & Outdoors.
5. All personal and accessory articles and/ or equipment that you wish to remove MUST BE TAKEN OFF THE BOAT BEFORE THE STORAGE PROCEDURE IS STARTED. We require that all electronics and personal property, dock lines, canvas, power cords, valuables, etc be removed as Bedford Sales & Outdoors is not responsible for any property left on the boat.
6. No tarps, covers or lines may be secured to any boats, trailers, cradles or stands while in winter storage unless approved by Bedford Sales & Outdoors. Resulting damage to boats and /or Bedford Sales & Sales property is the responsibility of the boat owner. Bedford Sales & Outdoors reserves the right to remove any cover that Bedford Sales & Outdoors determines to be unacceptable.
7. No hazardous materials may be stored within, under or around the boat at any time. Boats should be stored with fuel tanks at least ¾ full but no more than 7/8 full to prevent overflow and to avoid excessive fuel vapor issues.
8. Boat owner is responsible for any winterization work to be performed on the boat, including any arrangements with authorized service providers. Bedford Sales & Outdoors is not responsible for the failure to properly winterize the boat or any resulting damage or loss.
9. Bedford Sales & Outdoors will attempt to schedule haul-out according to owner’s requests, but actual haul- out is at the discretion of Bedford Sales & Outdoors.
10. All storage boats must be removed from Bedford Sales& Outdoors facilities by April 30th 2022 (year-round storage customers excluded). Boats not removed by April 30th, 2022 may be transported offsite and owners will be responsible for all costs including but not limited to transportation, storage and penalties.
11. All storage boats (indoors and outdoors) payments are due by the 1st of each month and are stored for a minimum of five months storage. If payment is not received by the 15th of the month a $25 late fee will be added to the balance on the account.
12. In the event of litigation, all attorney fees are the responsibility of the boat owner.
